These Terms and Conditions govern the services offered on the taktaktak.ch website under the “TAK TAK TAK by Schuster Design” brand.

The taktaktak.ch website and the “TAK TAK TAK by Schuster Design” service are operated by Schuster Design, a sole proprietorship under Swiss law, headquartered in Ormont-Dessous.

2. Scope

These terms and conditions apply to all event services offered under the “TAK TAK TAK by Schuster Design” package, including the rental of giant wooden games, the provision of temporary play areas, delivery, setup, takedown, entertainment, and operational support for events.

These terms and conditions apply unless otherwise agreed in writing. In the event of any conflict between these general terms and conditions and an offer, quotation, or specific written confirmation, the individual document agreed upon in writing shall prevail.

3. Formation of the Contract

Requests submitted via the website, by email, by phone, or by any other means do not in themselves constitute a definitive acceptance.

The contract is deemed to have been concluded when the customer accepts an offer or quotation issued by TAK TAK TAK by Schuster Design, including by signature, written confirmation, acceptance via email, or any other form of written agreement.

TAK TAK TAK by Schuster Design reserves the right to refuse a request or reservation, including for reasons of security, availability, logistics, operational feasibility, legal compliance, or to protect its reputation.

4. Services

Services may include, among other things:

- temporary rental of giant wooden games;

- the creation and operation of activation or play areas for events;

- delivery, installation, and dismantling;

- on-site presence and operational support;

- facilitation or moderation, depending on the agreed-upon service.

The exact scope of services is set forth in the relevant estimate, proposal, or written confirmation.

5. Price

The applicable prices are those listed in the offer or quote accepted by the customer.

Unless otherwise specified, prices are quoted in Swiss francs (CHF). Additional costs, including travel, logistics, supplementary services, or specific customer requests, may be billed separately if they are not expressly included in the quote.

6. Billing and Payment

Unless otherwise agreed in writing, the invoice is issued after the service has been provided.

The payment term is 30 days from the invoice date, with no discount.

TAK TAK TAK by Schuster Design reserves the right to request a deposit or advance payment for certain services, particularly in the case of large-scale events, significant advance bookings, specific preparatory costs, or increased risk. In such cases, this will be indicated in the offer or quote.

In the event of late payment, TAK TAK TAK by Schuster Design is entitled to charge late payment interest as provided by applicable law, as well as reasonable costs associated with reminders and collection efforts.

7. Modification, postponement, and rescheduling

The customer may request to reschedule an event up to two times within a six-month period from the originally agreed-upon date, subject to the availability of TAK TAK TAK by Schuster Design.

Any postponement must be agreed upon in writing.

In principle, a rescheduling agreed upon under these terms does not incur cancellation fees. However, costs that have already been incurred and cannot be recovered—such as third-party fees or specific expenses already incurred for the event—may be billed to the client.

If no agreement can be reached on a new date within six months, or if the customer exceeds the permitted number of reschedules, the situation may be treated as a cancellation in accordance with Section 8 below.

8. Cancellation by the customer

If the client cancels the event permanently rather than postponing it, or if no new date can be set under the conditions set forth in Article 7, TAK TAK TAK by Schuster Design is entitled to charge a penalty equal to 75% of the agreed price.

Expenses already incurred and not recoverable, to the extent that they exceed this compensation or must be paid in addition to it according to the offer, may also be billed if they are justified.

This rule takes into account the fact that reserving a date ties up capacity, incurs organizational costs, and may result in the loss of other contracts.

9. Weather, Safety, and Adjustments to the Service

The services provided by TAK TAK TAK by Schuster Design are wholly or partly dependent on weather conditions and on-site safety conditions.

TAK TAK TAK by Schuster Design makes every reasonable effort to adapt the event to weather conditions, including by combining or scaling back certain activities, utilizing available shelters, or implementing a modified version of the event.

However, TAK TAK TAK by Schuster Design does not guarantee that a full event can take place under all weather conditions, particularly in the event of heavy rain, strong winds, thunderstorms, weather alerts, slippery terrain, danger to participants, risk to equipment, or other conditions that are objectively unsuitable or dangerous.

For security reasons, TAK TAK TAK by Schuster Design may at any time modify, reduce, suspend, discontinue, or refuse all or part of the service. Such a decision does not constitute a breach of contract.

In the event of weather or safety conditions that are objectively incompatible with the reasonable provision of the service, the parties shall, in principle, give priority to rescheduling in accordance with the terms of Article 7.

10. Force Majeure and Events Beyond Our Control

Neither party shall be liable for any failure to perform or delay in performing its obligations if such failure or delay results from a force majeure event or an event beyond its reasonable control.

These include, but are not limited to: natural disasters, storms, severe weather, fires, pandemics, widespread transportation disruptions, government measures or bans, serious public disturbances, major breakdowns beyond the control of TAK TAK TAK by Schuster Design, or any other unforeseeable and unavoidable event.

In such a case, TAK TAK TAK by Schuster Design may propose a postponement, a modification of the service, or, if this is not reasonably possible, terminate the contract. Any amounts already paid will then be applied to a new date or refunded, less any costs already incurred and that cannot be recovered, depending on the circumstances.

Any liability for indirect damages, business losses, loss of revenue, loss of profits, or other consequential damages is excluded to the extent permitted by applicable law.

11. Customer Obligations

The client agrees to provide TAK TAK TAK by Schuster Design, in a timely manner, with all information necessary for the proper performance of the service.

The customer warrants, in particular, that:

- that the information provided regarding the event is accurate and complete;

- that sufficient, stable, accessible, and suitable space is provided;

- that the conditions for access, loading, unloading, and installation are met;

- that, where necessary, the power supply, permits, site approvals, and required organizational measures are in place;

- that a contact person who can be reached and is authorized to make decisions is present or designated for the event;

- that participants follow the safety guidelines.

The client remains responsible for obtaining any necessary administrative approvals, venue usage permits, event permits, and other agreements within its purview.

12. Impossibility of performance due to the customer

If the performance of the service is rendered impossible, significantly more difficult, or substantially impaired due to inaccurate or incomplete information provided by the client, insufficient access, unsuitable premises, lack of authorization, failure to meet promised technical requirements, or any other circumstance within the client’s control, TAK TAK TAK by Schuster Design is entitled to charge all or part of the agreed price as well as any costs already incurred.

13. Use of Facilities and Participant Safety

Playground equipment, facilities, and activities must be used for their intended purpose and in accordance with the instructions provided on site.

TAK TAK TAK by Schuster Design reserves the right to exclude, suspend, or restrict access to certain games or activities in the event of dangerous behavior, inappropriate use, failure to follow instructions, risk to participants, or risk of damage to equipment.

Children must remain under the supervision of their parents, legal guardians, or responsible adults, unless otherwise specified in a written agreement that expressly provides for special supervision.

14. Liability

TAK TAK TAK by Schuster Design is liable for damage caused intentionally or through gross negligence, as well as in other cases where liability is mandatory under applicable Swiss law.

To the extent permitted by applicable law, liability for slight negligence, indirect damages, consequential damages, loss of profits, loss of revenue, business interruption, loss of reputation, loss of event revenue, or damages resulting from the acts of third parties is excluded.

TAK TAK TAK by Schuster Design is not liable for any consequences resulting from:

- weather conditions;

- decisions made by the authorities or the host location;

- an insufficient number of participants or visitors;

- a lack of shelters, infrastructure, or protection provided by the client;

- inaccurate or incomplete information provided by the customer;

- circumstances within the control of the client or a third party.

15. Safety, Equipment Compliance, and Limits of Use

15.1 TAK TAK TAK by Schuster Design selects, maintains, and regularly inspects its games and installations to ensure, to the extent reasonably possible, their safe use at events. Some games are supplied by professional manufacturers, while others are designed, adapted, or built by TAK TAK TAK by Schuster Design.

15.2 Unless otherwise specified in writing, the games and equipment provided by TAK TAK TAK by Schuster Design are intended for their intended use, under the supervision of responsible adults, and for normal contact with the hands (e.g., handling game pieces). They are not intended to be put in the mouth, licked, chewed, or used as toys for infants or very young children.

15.3 When games or components are used in a context primarily involving young children or in a manner comparable to that of toys as defined by applicable regulations, the customer agrees to notify TAK TAK TAK by Schuster Design at the time of booking so that, if necessary, the concept can be adapted, appropriate materials can be selected, or certain uses can be restricted.

15.4 TAK TAK TAK by Schuster Design uses, to the extent possible and for the equipment in question, materials and coatings suitable for their intended use and relies on the information and documents provided by its suppliers (e.g., technical data sheets, declarations of conformity, information regarding applicable standards). The customer acknowledges that, unless expressly stated otherwise in the offer, the equipment provided is not designed or certified for medical or therapeutic use, nor for individuals with special needs regarding chemical sensitivity.

15.5 The customer is responsible for ensuring that participants, and in particular children, do not use the activities and installations in a manner that violates these terms and conditions or the instructions provided on site, including by preventing play items from being put in the mouth, bitten, or chewed.

16. Damage to equipment and installations

The customer is liable for any damage caused to equipment, games, facilities, or items made available when such damage results from use contrary to instructions, negligent conduct, actions by participants under the customer’s supervision, or a breach of the customer’s contractual obligations.

TAK TAK TAK by Schuster Design reserves the right to charge for repairs, replacements, or related costs if the damage is attributable to the customer or their sphere of influence.

17. Insurance

TAK TAK TAK by Schuster Design holds professional liability insurance covering its business activities within the limits and subject to the terms of the applicable insurance policy.

However, the existence of insurance does not imply an admission of liability in a specific case and does not alter the scope of contractual liability as defined in these general terms and conditions.

18. Intellectual Property and Media

Unless otherwise agreed, all concepts, visuals, text, photographs, presentations, documents, proposals, content, and creative materials provided or presented by TAK TAK TAK by Schuster Design remain its intellectual property.

The reproduction, distribution, transmission, or reuse of this material, in whole or in part, requires prior written consent.

19. Data Protection

The processing of personal data is governed by the privacy policy published on the taktaktak.ch website.

20. Governing Law and Jurisdiction

These Terms and Conditions, as well as the contractual relationship between TAK TAK TAK by Schuster Design and the customer, are governed by Swiss law, excluding conflict-of-laws rules.

Subject to any mandatory jurisdiction provisions under applicable law, the exclusive venue shall be the headquarters of Schuster Design, located in the canton of Vaud.

21. Authoritative version

The French version of these terms and conditions shall prevail.

22. Amendments

TAK TAK TAK by Schuster Design may amend these terms and conditions at any time. Unless otherwise agreed, the version published on the website at the time the contract is concluded shall apply.
